Terms of Service

Welcome to InterviewCaddy. These Terms of Service ("Terms") govern your use of the InterviewCaddy desktop application, mobile applications (when available), website at interviewcaddy.com, and related services (collectively, "the Service") operated by InterviewCaddy ("we," "us," or "our").

By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use InterviewCaddy. By using the Service, you represent and warrant that you meet this requirement.

If you are using InterviewCaddy on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your password and account credentials secure
  • Notify us immediately of any unauthorized account access

You are responsible for all activity under your account.

3. Acceptable Use

InterviewCaddy is designed to support interview preparation and provide coaching tools. You agree to use the Service in accordance with these Terms and all applicable laws.

3.1 You may use the Service to:

  • Practice for interviews using AI-powered mock interview sessions
  • Receive real-time coaching prompts during practice sessions
  • Track your performance and prepare for upcoming opportunities
  • Use Live Assist during conversations as a personal preparation aid

3.2 You agree NOT to:

  • Use the Service in any manner that violates applicable laws, regulations, or third-party rights
  • Use the Service to harass, defame, or harm others
  • Attempt to reverse-engineer, decompile, or extract source code from the application beyond what is permitted by applicable law
  • Resell, redistribute, or commercially exploit the Service without our written permission
  • Use automated tools (bots, scrapers) to access the Service
  • Share your account credentials with others or use someone else's account
  • Upload content that is illegal, infringing, malicious, or contains personal information of others without their consent
  • Use the Service in a manner that exceeds reasonable usage limits or interferes with other users (see Fair Use Policy)

3.3 Use During Real Interviews

InterviewCaddy provides tools that may be used during real interview conversations. Many candidates use the Service for preparation only. Others use Live Assist as a real-time coaching aid in actual interviews.

You are solely responsible for ensuring your use of the Service complies with the policies of the company or organization conducting your interview. Some companies prohibit AI assistance during interviews. Some allow it. Some have no policy. It is your responsibility to:

  • Review and understand the interviewing company's policies on AI assistance
  • Disclose your use of AI tools when required by applicable policies or laws
  • Comply with any non-disclosure agreements or terms you have agreed to with the interviewing party

InterviewCaddy is a tool; how, when, and where you use it is your decision and your responsibility. We provide the technology; you provide the judgment.

4. Subscriptions and Payments

4.1 Plans

InterviewCaddy offers free and paid subscription plans. Plan details, pricing, and included features are described on our pricing page. Paid plans include:

  • Weekly: billed every 7 days
  • Monthly: billed every 30 days
  • Yearly: billed every 365 days

Plan limits, including session counts and usage caps, are subject to our Fair Use Policy.

4.2 Billing

Paid subscriptions are billed in advance at the start of each billing period through our payment processor (Stripe). By providing a payment method, you authorize us to charge that method for all fees incurred.

4.3 Automatic Renewal

Paid subscriptions automatically renew at the end of each billing period unless you cancel before renewal. Renewal is billed at the then-current rate.

4.4 Cancellation

You may cancel your subscription at any time from within the application or by contacting support. Upon cancellation:

  • You retain access to paid features until the end of your current billing period
  • No prorated refunds are issued for the remainder of the billing period
  • You will not be charged for subsequent billing periods

4.5 Refunds

We offer refunds within 7 days of initial purchase if you have not used the Service substantially during that period. Refunds for renewal charges are not provided. To request a refund, email support@interviewcaddy.com within the eligibility window.

4.6 Price Changes

We may change prices for the Service. Existing subscribers will be notified at least 30 days before any price change takes effect. Continued use after the effective date constitutes acceptance of the new pricing.

5. Free Trial

The free plan provides limited access to the Service for evaluation purposes:

  • 15-minute Live Assist trial
  • 1 mock interview session
  • Basic feedback

Free plan limits are documented in the Service and may change with notice.

6. Intellectual Property

6.1 Our Content

The Service, including all software, design, text, graphics, logos, and other materials, is owned by InterviewCaddy or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

6.2 Your Content

You retain ownership of content you upload to the Service, including your resume, job descriptions, and audio recordings of your practice sessions ("Your Content").

By uploading Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and store Your Content solely for the purpose of providing the Service to you.

We do not use Your Content to train AI models or share Your Content with third parties for marketing purposes.

6.3 AI-Generated Output

Output generated by the Service in response to your inputs ("Output") is provided to you for your personal use. You may use Output in connection with your interview preparation. The Service is built on third-party AI models; the legal status of AI-generated content is evolving, and we make no representations about the copyrightability or ownership of Output beyond what is permitted by applicable law.

7. AI Limitations and Disclaimers

InterviewCaddy uses artificial intelligence to generate suggestions, prompts, and feedback. AI output:

  • May contain inaccuracies, omissions, or errors
  • Is not a substitute for professional career advice, legal advice, or human judgment
  • May not reflect current information about specific employers or industries
  • Should be reviewed and evaluated by you before use

You are responsible for the content of any answer you give in an actual conversation, whether or not it was suggested by the Service. The Service is a coaching tool. It is not a script. It does not guarantee any outcome, including any job offer.

8. Privacy

Our Privacy Policy describes how we collect, use, and protect your information. By using the Service, you agree to the Privacy Policy.

9. Termination

9.1 Termination by You

You may stop using the Service and delete your account at any time.

9.2 Termination by Us

We may suspend or terminate your access to the Service at any time, with or without notice, if:

  • You violate these Terms or our Fair Use Policy
  • You engage in conduct that we determine, in our reasonable judgment, harms other users, our business, or third parties
  • Required by law or court order
  • We discontinue the Service

Upon termination, your right to use the Service ends immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and dispute resolution) will survive.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

We do not warrant that:

  • The Service will meet your specific requirements or expectations
  • The Service will produce any particular result, including job offers
  • The AI-generated output will be accurate or appropriate for any specific situation
  • The Service will be available at all times or free from technical issues

You use the Service at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL INTERVIEWCADDY, ITS OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR:

  • Any indirect, incidental, consequential, special, exemplary, or punitive damages
  • Lost profits, lost revenue, lost data, or business interruption
  • Damages arising from your use of or inability to use the Service
  • Damages arising from any decisions you make based on the Service, including interview outcomes or career decisions
  • Damages arising from third-party services or content

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. To the extent such jurisdictions apply, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless InterviewCaddy, its officers, employees, agents, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms or our Fair Use Policy
  • Your violation of any third-party right, including any interviewing company's policies on AI use
  • Your content uploaded to the Service

13. Third-Party Services

The Service integrates with third-party services, including:

  • AI model providers (OpenAI, Anthropic, Google, and others)
  • Payment processing (Stripe)
  • Voice transcription and synthesis (Deepgram)
  • Video conferencing tools (Zoom, Teams, Meet — used alongside but not integrated)

Your use of those third-party services is governed by their respective terms. We are not responsible for third-party services.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of Ontario, Canada, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved in the courts of Ontario, Canada, and you consent to the jurisdiction of those courts.

If you are a consumer located outside of Canada, mandatory consumer protection laws of your jurisdiction may also apply.

16. General

16.1 Entire Agreement

These Terms, together with the Privacy Policy and Fair Use Policy, constitute the entire agreement between you and InterviewCaddy regarding the Service.

16.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

16.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms freely.
